1. About Newish

Newish is operated by FZ-C.L.L Newish, a company registered in the United Arab Emirates under licence number 2526783.01, with its registered address at Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, U.A.E.

Newish is a consumer to consumer marketplace. We provide a platform that allows users to buy and sell second hand items. We are not a party to transactions between users.

2. Acceptance of these Terms

By accessing or using the Newish mobile application, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the app.

We may update these Terms from time to time. Continued use of the app means you accept the updated Terms.

3. Eligibility and accounts

• You must be at least 18 years old to use Newish.
• You must create an account to browse, buy or sell.
• You are responsible for keeping your account details secure.
• You must provide accurate and complete information.

4. Marketplace role

Newish does not own, inspect or verify items listed on the platform and does not guarantee item quality, safety, legality or authenticity. All sales contracts are between buyers and sellers only.

5. Listings and user content

Sellers are responsible for their listings, including descriptions, images, pricing and legal compliance. You must not list illegal, unsafe or counterfeit items.

By posting content, you grant Newish a non exclusive, worldwide, royalty free licence to use that content for operating and promoting the platform.

6. Messaging and reviews

Users may message one another and leave reviews. You must not harass other users, post misleading information, or attempt to bypass platform payments.

We may remove content or restrict accounts at our discretion.

7. Payments and buyer protection

Payments are processed through Stripe. A buyer protection fee is included in the listed price and paid by the buyer.

Funds are held until delivery is confirmed. Buyer protection applies where items are not received, damaged, or materially different from the listing.

8. Shipping, disputes and returns

Sellers are responsible for shipping. Buyers may raise disputes within the timeframe shown in the app. Returns are permitted only where a valid dispute is accepted.

9. Suspension and termination

We may suspend or terminate accounts that breach these Terms, engage in fraud, or create risk for the platform or other users.

10. Liability

The platform is provided on an “as is” basis. To the maximum extent permitted by law, Newish is not liable for losses arising from user transactions.

11. Governing law

These Terms are governed by the laws of the United Arab Emirates and subject to the exclusive jurisdiction of UAE courts.
